What are the noise restrictions at Cathedral Place?
The noise restrictions are governed by the Cathedral Place By-laws which prohibit any noise that might interfere with the peaceful enjoyment or other residents. This includes noise from both residents and their visitors. The following is the relevant By-law (Section 6)
(a) A Proprietor of a lot, their guests, servants or agents shall not make or permit any noise likely to interfere in any way with the peaceful enjoyment of other proprietors of lots or any person lawfully using the common property. In particular no proprietor of a lot shall hold or permit to be held any social gathering in his lot which would cause any noise which un lawfully interferes with the peace and quietness of any other proprietor of a lot, at any time of day or night and in particular shall comply in all respects with the Noise Abatement Act 1979, as amended.
(b) In the event of any unavoidable noise in a lot at any time the proprietors thereof shall take all practical means to minimize annoyance to other proprietors of lots by closing all doors, windows and curtains of his lot and also such further steps as may be within his power for the same purpose and shall cease the activity creating a noise or nuisance upon the request of the Body Corporate through its representative.
(c) Guests leaving after 11.00pm shall be requested by their hosts to leave quietly. Quietness also shall be observed when a proprietor of a lot returns to the dwelling late at night or early morning hours.
What happens if people complain about the noise I or my visitors make?
If a complaint is made, either the Caretaker or security will come and ask you to reduce the noise levels immediately. If the noise is not reduced to an acceptable level, the police will be called and a notice of failing to abide by the by-laws will be issued to the resident and/or to the owner if you are a tenant. At all times, the resident (whether tenant or owner) is responsible for the conduct of any visitors they may have invited on to the property at Cathedral Place.
What about noise from renovations or repairs to my unit?
Normally work can be completed between the hours of 8:00 a.m. and 5:00 p.m. Monday to Friday or 9:00 a.m. to 4:00 p.m. on Saturday. However, if the renovations involve loud noise (i.e, the use of loud drills or jack hammers), then you must seek written approval from the Body Corporate before proceeding, and clear instructions re acceptable times will be provided. Neighbours and those around who may be affected must be notified well in advance of the work being undertaken.
